These Terms of Service ("Terms") govern all services provided by Alabama Polylift, a division of MSA Industries, LLC ("Company," "we," "us," or "our") to our customers ("Customer," "you," or "your"). By requesting an estimate, scheduling service, or accepting our work, you agree to these Terms.

1. Services Provided

Alabama Polylift provides professional polyurethane foam concrete lifting, leveling, void filling, crack sealing, concrete sealing, and related concrete repair services for residential and commercial properties throughout the State of Alabama.

2. Estimates & Proposals

  • All on-site estimates are provided free of charge with no obligation
  • Written proposals are valid for 30 days from the date of issuance unless otherwise noted
  • Estimates are based on visible conditions at the time of inspection. Final pricing may be adjusted if hidden conditions (such as voids, deteriorated sub-base, or utility conflicts) are discovered during the work
  • Any price adjustments will be communicated to the Customer before additional work proceeds
  • Verbal quotes are not binding; only written proposals signed by an authorized Company representative constitute an offer

3. Work Authorization

  • By signing a proposal or providing verbal/written authorization, the Customer confirms they are the property owner or have legal authority to authorize work on the property
  • The Customer warrants that they have obtained any necessary approvals from homeowners associations, landlords, or other governing parties prior to scheduling work
  • For commercial properties, the authorizing party represents they have authority to bind the business entity to these Terms

4. Scope of Work

Our services include:

  • Polyurethane foam injection to lift and level concrete slabs
  • Void filling beneath concrete surfaces
  • Crack sealing and concrete surface sealing
  • Concrete cleaning and preparation as specified in the proposal
  • Patching of injection holes with color-matched concrete

Our services do NOT include:

  • Concrete replacement, removal, or new concrete pouring
  • Repair of pre-existing cracks, spalling, or surface damage unless specifically quoted
  • Structural engineering assessment or certification
  • Landscaping, irrigation, or utility relocation
  • Permits, unless explicitly stated in the proposal

5. Customer Responsibilities

Prior to our arrival, the Customer agrees to:

  • Provide clear access to the work area for personnel and equipment
  • Remove vehicles, furniture, planters, and personal property from the work area
  • Identify and mark the location of any underground utilities, sprinkler lines, or drainage systems in the work area
  • Secure pets and ensure the work area is safe for our crew
  • Notify us of any known hazards, property restrictions, or special conditions

Failure to prepare the site may result in rescheduling and potential service fees.

6. Site Conditions & Property

  • Concrete lifting involves drilling small holes (typically 3/8" to 5/8" diameter) through the concrete surface. These holes are patched but may remain visible
  • Some cosmetic effects are normal, including minor grout discoloration, hairline cracks from movement, or foam residue at joints
  • We are not responsible for pre-existing damage, including cracks, stains, discoloration, or deterioration present before our work begins
  • In rare cases, heavily deteriorated concrete may crack further during the lifting process. If this occurs, we will discuss options with the Customer
  • We will take reasonable precautions to protect landscaping and property, but some minor disturbance (tire marks, foot traffic, equipment placement) may occur in the work area

7. Warranty

Alabama Polylift provides the following warranty on our work:

Workmanship Warranty: We warrant that our work will be performed in a professional manner consistent with industry standards. If a defect in our workmanship causes the concrete to settle within the warranty period, we will re-lift the affected area at no charge.

Warranty Period: Unless otherwise specified in your proposal, our standard warranty period is 5 years from the date of service completion.

What is NOT Covered:

  • Settlement caused by new construction, excavation, or changes to drainage on or adjacent to the property
  • Damage from flooding, earthquakes, sinkholes, or other acts of nature
  • Movement caused by tree roots, erosion, or soil conditions beyond our control
  • Cosmetic issues such as cracks, stains, discoloration, or surface wear
  • Damage caused by vehicle impact, heavy equipment, or loads exceeding the concrete's design capacity
  • Modifications to the property or concrete made by others after our service
  • Properties where our maintenance recommendations were not followed

Warranty Claims: To make a warranty claim, contact us in writing at [email protected] or by phone at (256) 257-4747. We will schedule an inspection within a reasonable timeframe. Warranty work is subject to our assessment that the issue is covered under these terms.

8. Payment Terms

  • Payment is due upon completion of service unless other arrangements have been made in writing
  • We accept cash, personal/business checks, and major credit cards (Visa, MasterCard, American Express, Discover)
  • For projects over $5,000, we may require a deposit of up to 50% to schedule the work
  • Financing options may be available for qualified customers through our third-party financing partners
  • Returned checks are subject to a $35 fee plus any bank charges
  • Accounts past due by 30 days may be subject to a late fee of 1.5% per month (18% annually) and collection costs

9. Cancellation & Rescheduling

  • You may cancel or reschedule appointments with at least 48 hours notice at no charge
  • Cancellations with less than 48 hours notice may incur a service call fee of up to $150
  • If our crew arrives and cannot perform work due to site conditions not disclosed by the Customer, a trip charge may apply
  • We reserve the right to reschedule due to weather conditions, equipment issues, or other factors beyond our control

10. Insurance & Licensing

  • Alabama Polylift maintains general liability insurance and workers' compensation coverage
  • Certificates of insurance are available upon request
  • We operate in compliance with all applicable Alabama state and local licensing requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability for any claim arising from our services shall not exceed the amount paid by Customer for the specific service giving rise to the claim
  • We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of use, loss of profits, or damage to other property
  • We are not responsible for damage to underground utilities, irrigation systems, or other buried items not disclosed or properly marked by the Customer

12. Indemnification

Customer agrees to indemnify and hold harmless Alabama Polylift, MSA Industries, LLC, and their officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney fees) arising from: (a) Customer's breach of these Terms; (b) Customer's misrepresentation regarding property ownership or authority; or (c) hazards or conditions on the property not disclosed to us.

13. Dispute Resolution

In the event of a dispute arising from our services:

  • Step 1: Contact us directly to discuss the issue. Most concerns can be resolved through direct communication
  • Step 2: If we cannot resolve the issue informally, either party may request mediation through a mutually agreed mediator
  • Step 3: If mediation fails, disputes shall be resolved through binding arbitration in Tallapoosa County, Alabama, in accordance with the rules of the American Arbitration Association

Each party shall bear their own costs, except the prevailing party in arbitration may recover reasonable attorney fees.

14. Force Majeure

We shall not be liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to: severe weather, natural disasters, pandemics, material shortages, labor disputes, government actions, or utility failures.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to conflict of law principles. Any legal action shall be brought in the state or federal courts located in Alabama.

16. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes constitutes acceptance of the modified Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with any signed proposal or work order, constitute the entire agreement between the parties and supersede any prior discussions or representations.
